Terms of Service
Welcome to KreaPlex. These Terms of Service ("Terms") govern your access to and use of the KreaPlex website, applications, and services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Accounts
You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Service. You agree to provide accurate, current information when creating an account, to keep your credentials secure, and to be responsible for all activity under your account. Notify us immediately of any unauthorized access.
2. Acceptable Use
You agree not to:
- violate any law, third-party right, or these Terms;
- upload, transmit, or distribute malware, spam, or unlawful content;
- attempt to gain unauthorized access to the Service or its systems;
- scrape, mass-export, or otherwise misuse data;
- impersonate another person or misrepresent your affiliation; or
- use the Service to harass, defame, or harm others.
3. Your Content
You retain ownership of content you post, upload, or generate through the Service ("Your Content"). You grant KreaPlex a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display Your Content solely as necessary to operate and improve the Service. You are solely responsible for Your Content and represent that you have all rights necessary to grant this licence.
4. Subscriptions, Fees and Refunds
Paid plans are billed in advance on a recurring basis. You authorise us and our payment processor to charge your payment method for each billing period until you cancel. Fees are non-refundable except where required by law or expressly stated. You may cancel your subscription at any time from your account; access continues through the end of the current billing period.
5. Intellectual Property
The Service, including its software, design, trademarks, and all related content (excluding Your Content), is owned by KreaPlex or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose during your subscription.
6. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use personal data.
7. Third-Party Services
The Service may integrate with or link to third-party services (e.g., payment processors, email providers, analytics). We are not responsible for those third parties; their terms and privacy policies apply to your use of them.
8. Suspension and Termination
We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, present a security or legal risk, or fail to pay fees due. You may close your account at any time. Provisions that by their nature should survive termination (e.g., disclaimers, limitation of liability, indemnification) will do so.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, KreaPlex and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless KreaPlex from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms.
12. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. If a change is material, we will provide reasonable notice (e.g., by posting on the Service or emailing you). Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which KreaPlex is established, without regard to conflict-of-laws rules. Any disputes will be resolved in the courts of that jurisdiction, unless mandatory consumer-protection laws of your country provide otherwise.
